تغيير جنسيت يكي از موضوعات مهمي است كه موجب پيدايش مسايل جديد حقوقي شده و تاكنون سابقه نداشته است. يكي از اين مسائل،‏وضعيت يا مشروع و نامشروع بودن خود عمل است. بنابراين از يك جهت اين پرسش مطرح مي شود كه آيا هر شخصي حق دارد كه جنسيت خود را تغيير دهد يا هيچ كس حق تغيير جنسيت خويش را ندارد و يا در شرايط و او ضاع و احوال خاصي حق دارد جنسيت خود را تغيير دهد. از طرف ديگر،‏ بعد از انجام عمل تغيير جنسيت،‏ سئوال ديگري مطرح مي شود كه آ يا چنين شخصي حق دارد،‏ خواهان تغيير جنسيت و نام خود درشناسنامه شود؟ به عبارت ديگر،‏ آ يا قانونگذار جنسيت ونام جديد را به رسميت مي شناسد ؟
بنابراين،‏ در اين مقاله مشروعيت تغيير جنسيت و شناسايي آ ن از طرف قانونگذار،‏ بر طبق قواعد حقوق ايران و فقه اسلامي مورد بررسي قرارگرفته است.

The sex-change is one of the important subjects that give rise to unprecedented legal problems which one of them is the legality or illegality of this act.
Therefore, from one side, this question will be raised that, if any person has the right to change his or her gender or has not or in the specific circumstances and conditions has this right.
From the other sides, after the operation of transgender, the other question will be raised that, if such person has the right to correct his or her birth certificate, or in other words, dose the legislature recognizes the new gender and new name?
In this Article, the legality or illegality of sex- change, in accordance with legal principle of Iranian Law and Islamic
jurisprudence, has been considered.
