معناي ارث آن است كه بازماندگان متوفي،‏ اموال و حقوق هاي او به حكم قانون مي باشد. در نظام حقوقي اسلا م اين نهاد به رسميت شناخته شده و در قرأن به آن تصريح شده و در روايات معصومين عليهم السلام نيز شرايط و تقريرات آن توضيح داده شده است. در احكام و مقررات ارث،‏ در بعضي از موارد سهم زن با مرد يكسان و در برخي از موارد ديگر سهم مرد بيشتر اززن معين شده است.
اختلاف سهم الارث زن ومرد،‏ ممكن است اين شبهه را ايجاد نمايد كه تفاوت سهم الارث زن ومرد در تمام اين موارد عادلانه نيست و براي برقراري عدالت و دفاع از حقوق زن با توجه به تفاوت شرايط خانوادگي و اجتماعي زنان و مردان معاصر با زمان صدر اسلام،‏ لازم است در اين تفاوت تجديد نظر شود. در اين مقاله تلاش شده است كه اين تفاوت با توجه به تعهدات مالي مردان در قبال زنان و نيز فرزندان توجيه و ثابت گرددكه درنظام حقوق اسلام،‏ حقوق مالي زنان نسبت به مردان مورد حمايت بيشتري قرار گرفته است.

Inheritance means that those relatives of the deceased who out live him inherit his property and rights by order of law. In Islamic law system, this custom has also been recognized and it has been specified in Quran as well. Besides, in the traditions of the innocent Imams (As), its conditions and stipulations have been explained.
In the orders and regulations of inheritance, in some cases woman’s portion is the same as man’s portion, and in some other cases man’s portion is more than woman’s portion. The difference between inheritance portion of woman and man may raise this doubt that the difference between inheritance portion of woman and man is not fair in all these cases. Besides, this difference needs to be reconsidered in order to administer justice and defend woman’s rights regarding change in family and social conditions of contemporary women and men as compared with those of the advent of Islam.
In this writing, it has been attempted to justify the difference between in heritance portion of woman and man in regard to financial commitments of men to women as well as children; and to prove that in Islamic law system, women’s financial rights have been more supported than those of men.
